Explanatory Study of jurisprudence Rules regarding the concession of circumstances and time

Abstract

Human life changes in different circumstances. There are many ups and downs from childhood to old age. Conditions like health and illness keep changing. In the same way, change of time affects human life. Islamic law is an eternal, perpetual, and universal Shari'ah, It provides guidance on the application of Shari'ah in all times and in all circumstances۔The jurists of Islam have discussed such matters in great detail in their books and using their ijtihad insights offered solutions to these problems in every age۔The jurists have interpreted such situations and conditions in terms of zaroorat, Ezterar, Hajat, Amoome Balwa,Urf etc. In this way, they have outlined a number of rules and regulations that can be used to solve problems. Scholars of jurisprudence have divided these rules by different references some known as Qawaid e Kulyah and some Qawaid e Juziyah. Similarly some denotes as Dawabit.But here in this research we will call them as Qawaid. Only those Qawaid will be mentioned here which deals with Circumstances and time. After that these will be elaborated by examples which are mentioned in the Juristic books. One of the advantages of invoking these rules is that it is easier to solve problems without memorizing the major jurisprudential details. Also, with the help of these rules, it is possible to solve many of the problems that are still present that need to be solved.
